Morocco: self-production of electricity is now workable

Korte Law - Morocco

Client alert · October 2026

Law 82-21 on self-production of electricity has been on the books since 2023. Its implementing decree, Decree 2-25-100 of 5 March 2026, was published in Bulletin officiel no. 7489 of 9 March 2026 and has applied since 9 June 2026 (Decree, art. 29). Companies can now build solar or other plants for their own sites under clear procedures and deadlines.

What changed

Self-production means producing electricity only for your own consumption. You must own the plant or hold the right to use it (Law, art. 2). The procedure depends on the plant's capacity; all plants on one site are added up (art. 11).

CapacityRegime and decision-makerDeadlines in the Decree
Below 11 kW, low voltageDeclaration to the distribution grid operator (Decree, art. 5-6)Receipt within 30 days of a complete file; build within 12 months (art. 8)
11 kW to 5 MW, low or medium voltageConnection agreement from the distribution grid operator, after a technical study paid by the applicant (art. 11-13)30 days from a complete file, plus capacity check (max. 15 days) and the study; build within 2 years of the connection contract (art. 14)
5 MW and above, medium, high or very high voltageAuthorisation from the energy ministry's regional services, after the grid operators' technical opinion (art. 18-20)30 days from a complete file, plus capacity check (max. 30 days), transmission operator opinion and the study; build within 2 years (art. 20)
Not connected to the gridDeclaration to the energy ministry's regional services (art. 1-4)Receipt within one month (art. 2, 4)

The grid operator carries out the technical study within 3 months of payment (Decree, art. 27). The 2-year build period can be extended once by up to one year for exceptional circumstances, on a reasoned request filed before it ends (Decree, art. 14, 20).

Who it helps

  • Industrial sites that want to cover their own load: the plant may be owned by the company or used under a right to dispose of it (Law, art. 2).
  • Larger projects (5 MW and above) can use the national grid to carry power from a remote plant to the consumption site, on medium or high/very high voltage (art. 7).
  • Surplus: up to 20% of annual production may be sold to the grid operator at a tariff set by the regulator ANRE (art. 12). Press reports cite MAD 0.21/kWh peak and MAD 0.18/kWh off-peak for medium and high voltage; we have not yet seen this in an official text.
  • Storage and certificates of origin for renewable power are provided for (art. 15-16; Decree 2-24-761).

Costs and limits: grid-connected self-producers pay the grid-use tariff plus an ANRE contribution for system and distribution services (art. 13). Grid hosting capacity is limited and reserved in order of date and time of filing (art. 14). Curtailment up to a threshold carries no compensation (art. 30).

What to do now

  • File early. Grid capacity goes to the first complete file (Law, art. 14; Decree, art. 7, 13, 19).
  • Existing plants must apply for regularisation within 18 months of entry into force (Law, art. 33). Check your deadline now.
  • Count all capacity on the site before choosing the regime (art. 11), and budget for the technical study (Decree, art. 27).
  • Other permits still apply, e.g. building and environment; from 11 kW the file includes an environmental impact study under the applicable legislation (Decree, art. 12, 18, 26).
  • Mind the fines: MAD 2,000-5,000 without a declaration (art. 28); MAD 100,000-1,000,000 without a connection agreement or authorisation (art. 29).
  • Still pending: the ministry's forms and online filing platform (Decree, art. 25), and ANRE's low-voltage surplus tariff and distribution-services contribution.

Selling power to third parties is a different regime: renewable plants under Law 13-09, as amended by Law 40-19, need only a declaration below 2 MW.

How we help

KORTE LAW, with offices in Rabat and Casablanca, advises German and European companies in German, English and French: choosing the regime, preparing declaration, connection-agreement and authorisation files, grid-connection and EPC contracts, leasing and third-party ownership structures, and regularising existing plants.
